2. Scope of These Terms

These Terms and Conditions govern the purchase of competition entries for the European Freediving Photography Award, organized by ASD La Parola del Mare Club. By completing a purchase on this website, you agree to be bound by these Terms, together with the Competition Regulations and our Privacy Policy.

3. What You Are Purchasing

Purchases made through this website consist of entry fees for one of the following competition categories: Club Challenge, Wild Blue, or Indoor Elegance, as described on the Categories page. Each entry grants the right to submit the corresponding number of photographs for evaluation by the jury, in accordance with the Competition Regulations.

4. Prices

All prices are displayed in Euro (€) and are inclusive of applicable taxes, where relevant. [TO BE VERIFIED: whether the association’s tax regime applies a VAT exemption to entry fees — confirm with the accountant.]

5. Payment

Payment is processed securely via [Stripe / active method at launch]. By providing payment details, you authorize ASD La Parola del Mare Club to charge the applicable entry fee.

6. Submission Process

Upon successful payment, you will receive access to the corresponding photo upload page. Submissions must comply with the requirements set out in the Competition Regulations, including file format, technical specifications, and consent declarations. It is your responsibility to complete your submission before the competition deadline stated in the Regulations.

7. Entry Fees and Refunds

Entry fees are non-refundable. Once an entry fee has been paid, no refund will be issued, regardless of whether the submitted work is selected, shortlisted, or awarded a prize, and regardless of the reason for withdrawal.

This policy reflects the nature of competition entries as services tied to a specific event with a fixed submission deadline (Article 59, paragraph 1, letter n, of the Italian Consumer Code, D.Lgs. 206/2005), consistent with standard practice across international photography competitions.

In the event of cancellation of the Competition by the Organizer, the provisions of Article 17 of the Competition Regulations shall apply.

8. Intellectual Property and Image Rights

By submitting photographs, participants retain ownership of their images but grant ASD La Parola del Mare Club the usage rights described in the Competition Regulations (Article 11.2 — License of Use). Participants are solely responsible for ensuring they hold the necessary rights and consents for any identifiable people depicted in submitted photographs.

9. Liability

ASD La Parola del Mare Club shall not be liable for technical issues beyond its reasonable control (e.g., internet connectivity issues on the participant’s end) that may prevent the completion of a submission. Participants are encouraged to complete their submissions well ahead of the deadline.

10. Complaints and Dispute Resolution

For any complaint, participants may contact us at info@freedivingphotoaward.com. In accordance with EU Regulation 524/2013, EU consumers may also access the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

11. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any dispute shall fall under the exclusive jurisdiction of the Court of Trieste, Italy, without prejudice to any mandatory consumer protection provisions applicable in the participant’s country of residence.

12. Language

These Terms are provided in English, Italian, and French. In the event of any discrepancy between versions, the Italian version shall prevail, consistent with the Competition Regulations.

13. Changes to These Terms

ASD La Parola del Mare Club reserves the right to update these Terms at any time. The version in force at the time of purchase shall apply to that transaction.
